What can you do if the insurer refuses to pay?
After a claim is reported, the insurance company may reject it, pay less than is due or not respond at all. In that situation, the first step is to submit a written application to the company.
Steps to take
- Collect evidence of the loss and supporting documents (accident report, loss adjuster's report, repair invoice, photographs).
- Submit a dated and signed written application to the insurer, and keep proof that it was received.
- If the response is negative, or no response is received in time, take the dispute to the Insurance Arbitration Commission or to court.
The Insurance Arbitration Commission
Policyholders and beneficiaries may bring their dispute before the Insurance Arbitration Commission instead of the courts. Arbitral awards may be challenged before an appeal arbitrator within the statutory period. Because the choice between arbitration and court affects the other route, consider this carefully before deciding.
Watch the deadlines
Limitation periods and application deadlines differ depending on the type of insurance. Showing a rejected claim to a lawyer without delay helps prevent the loss of your rights.
