How is overtime pay calculated and proven?
The law sets the maximum weekly working time at 45 hours. Work beyond this is overtime and must be paid separately.
How is it calculated?
Each hour of overtime is paid at the normal hourly wage increased by fifty percent. Overtime cannot be required without the employee's consent, and the law also sets an upper limit on annual overtime.
How is overtime proven?
- Payroll and timesheet records
- Entry and exit records (card access, fingerprint)
- Workplace correspondence and emails
- Witness statements
Before signing your payslip, check that your working hours are recorded correctly. It is possible to sign with a reservation for missing or incorrect items.
Before filing a lawsuit
For overtime claims too, you must first apply to a mediator. Do not delay your claim, so that it does not become time-barred, and seek legal advice.
