What is attachment, and which assets cannot be seized?

Attachment (haciz) is the seizure, through state authority, of the assets of a debtor who has not paid the debt in enforcement proceedings. Its purpose is to collect the receivable, but not every asset can be attached.

What can be attached?

Movable and immovable property, vehicles, bank accounts, receivables held by third parties and the portion of wages permitted by law may be attached.

Assets exempt from attachment

Certain assets listed in the Enforcement and Bankruptcy Code cannot be attached. For example:

  • Essential household goods and clothing of the debtor and the family members living with them
  • Tools and equipment essential for the debtor to practice their profession (subject to certain conditions)
  • Certain food and fuel needed for the debtor's subsistence
  • Certain income and allowances that the law protects from attachment

What to do

  • Review the attachment report and the list of attached assets.
  • If an exempt asset has been attached, file a complaint within the short period set by law.
  • If you pay the debt, make a written request for the attachments to be lifted.
  • If you are a creditor, carry out an asset search to direct the attachment to the right assets.
